Welcome to PublicJunctionCenter ("we," "our," or "us"). These Terms & Conditions ("Terms") regulate your engagement with our yacht charter services and the website available at publicjunctioncenter.sbs (the "Service") managed by PublicJunctionCenter.
When you reserve a charter or utilize our Service, you consent to comply with these Terms. If you are not in agreement with any section of these terms, you are not permitted to use the Service.
2. Service Overview
PublicJunctionCenter offers exclusive yacht charter services which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Access to all services is contingent upon availability and climatic conditions. We hold the authority to alter or discontinue services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, you must:
- Be a minimum of 18 years old
- Provide precise and complete details
- Remit the necessary deposit detailed in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed upon the payment receipt and our formal acknowledgment. We have the liberty to decline service to any individual as per our discretion.
3.3 Availability
Charters are reserved based on the accessibility of vessels and favorable weather conditions. We shall strive to accommodate your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All the prices are quoted in € and encompass applicable taxes unless indicated otherwise. Prices are amenable to modifications without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the complete charter cost payable upon booking
- Balance: Payable 48 hours before the commencement of the charter
- Additional expenses (if any): Payable at the end of the charter
4.3 Payment Methods
We accept major credit cards, bank transfers, and certified cheques. Payment processing is executed through secure, encrypted frameworks.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete refund minus transaction fees
- 24-72 hours before departure: 50% refund
- Under 24 hours before departure: No refund provided
5.2 Weather Cancellations
If our captain deems weather conditions as unsafe, we will propose to:
- Reschedule the charter to an alternative date at no added cost
- Issue a full refund if rescheduling is unachievable
5.3 Mechanical Issues
In the case of mechanical faults with the assigned yacht, we will endeavor to offer a comparable substitute. Should no replacement be available, a complete refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all directions given by the crew
- Utilize the provided safety gear as necessary
- Declare any medical conditions that might impact their safety
- Stay within designated spaces on the vessel
6.2 Prohibited Items
The following are not allowed aboard:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive soft drinks (beyond reasonable consumption)
- Pets (except with prior approval)
6.3 Conduct
All passengers should behave respectfully. Any behavior that is unsafe or disrupts the charter may result in early termination without a refund.
7. Liability and Insurance
7.1 Our Liability
We are only accountable up to the cost paid for your charter. We are not responsible for:
- Injuries caused by the guest's negligence
- Loss or damage to personal belongings
- Indirect, incidental, or punitive damages
- Delays due to weather or events outside of our command
7.2 Insurance Coverage
We keep extensive marine insurance for our vessels and operations. It is advised that passengers have their own travel and personal insurance.
7.3 Assumption of Risk
By partaking in our charter services, you recognize that boating activities carry inherent risks and you assume the responsibility for your personal safety and welfare.
8. Modifications and Itinerary Changes
We hold the right to modify itineraries, paths, or schedules depending on weather conditions, safety concerns, or operational necessities. We will attempt to craft comparable alternative experiences.
9. Force Majeure
We bear no liability for interruptions, cancellations, or changes caused by events outside our control, including:
- Extreme weather
- Natural catastrophes
- Government directives
- Harbor shutdowns
- Technical failures
10. Privacy and Data Protection
Your personal information is treated in line with our Privacy Policy. By employing our services, you agree to the gathering and use of your data as outlined in our Privacy Policy.
11. Intellectual Property
The content on our website, like text, graphics, logos, and images, is secured by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our written consent.
12. Governing Law
These Terms shall be governed by the laws in force in Spain. Any legal matters shall be settled in the courts located in Barcelona, Spain.
